Rogue State?

Would you consider a nation that is currently in possession of nuclear weapons, and developing more, a rogue state if it declared its intention to use them preemptively, as it saw fit? What if that nation refused to abide by standards of international law, even charters and treaties that it had not only signed but actually sponsored? What if the nation declared its inalienable right to attack other nations unilaterally, and without publicly divulging its reasons for doing so?
